AN INSULT TO CORTNEY’S

FAMILY AND FRIENDS

(“I believe my son is innocent,” Intell, 1-26-05)

She was “missing” for six months.  She had a two-week old baby.  Her family put up two websites looking for information.  Her family started a reward fund.  Her family held vigils and handed out buttons with her picture on it.  Her case was listed on several websites devoted to missing persons.

Her body was found on Saturday, January 22, 2005.  On Monday, January 24, District Attorney Donald Totaro and county Coroner Dr. G. Gary Kirchner issued a joint statement identifying the remains found as those of Cortney Fry.

On January 26, the Intelligencer Journal ran an article titled, “I believe my son is innocent” by Brett Lovelace.  Two days after her death was confirmed, the family of Cortney Fry had to deal with an article that had blatant falsehoods, was hurtful and ridiculous.

Cortney Fry’s boyfriend’s father, David Stewart was quoted as saying he sits in his apartment waiting for telephone calls from his son who is in jail.  The article says, “The teen passes time in jail playing chess, his father said.”

The “teen” had been in jail for a whole of five days on unrelated charges.

The article quotes Stewart as saying, “Cortney was my daughter-in-law…”  This is simply not true.  How did this get past a reporter and several editors?  They were not married.  The reporter should have called that to Mr. Stewart’s attention and an editor should have never left this error in the article.

Stewart is quoted as saying, “Micah loved being a father. …He was helping Giavanni learn to walk…”  Children, on average, learn to walk somewhere between ten months and a year.  How did this get by a reporter and several editors?  Was it confirmed that, as Stewart said, “Micah often visited his 7 month-old daughter?”  Several posters on LOL Talkback have indicated this was not the case. And, actually, the baby was closer to six-months old than seven when this article was written.

Stewart is quoted as saying that life became “unbearable” for his son after Cortney disappeared.  Do you think it was “bearable” for her family?

Why would any newspaper in the country run such a hurtful, factually incorrect and absurd story two days after the death of Cortney Fry was confirmed?  Did the police ask the paper to run the story?  Were they trying to deflect attention away from the obvious suspect in the case?

One day before this article, the same author wrote, “Missing person case ends; homicide probe begins.”  He says, “Detectives initially focused on Stewart, who shared an apartment in Columbia with Fry and sired her daughter.  Police broadened their scope after Stewart denied having anything to do with the disappearance.”

No wonder the police and detectives seem to have a hard time solving crimes in Lancaster County.  Apparently, all suspects have to do is deny their involvement in a crime and they are absolved.

Luckily, those investigating the disappearance and murder of Laci Peterson didn’t follow this rationale.

BRING IN OUTSIDE HELP TO SOLVE THIS CASE.

A KILLER IS ON THE LOOSE.

A KILLER IS ON THE LOOSE

                      Bring in Outside Help

(There appears to be no progress in finding the murderer of Cortney Fry)

In the space of 45 minutes a 19 year-old woman named Cortney Fry disappeared from her Columbia apartment leaving her two-week old baby behind.  Her body was found almost six months later.  According to reports, she had a hole in her scull, possibly from a gunshot wound, two broken legs and her body had been burned.

So how did a woman end up dead in the space of forty-five minutes?  Mothers of two-week old babies do not leave their babies.  She would not have left the apartment without taking her baby.  Every mother knows that.  So, that means either someone she knew or a complete stranger, knocked on her door during that forty-five minute window of time and forced her to leave without taking her baby.

Who could this person have been?  Surely the detectives, who have had six months to investigate every aspect of her background and life, must have some ideas.

Was she seeing someone besides her boyfriend who might have been jealous?  Jealous enough to kill her and burn her body?  Was she involved in drugs and murdered over a drug deal gone wrong?   Did a cult member just happen to knock on her door during that forty-five minute window of time and kill her in some kind of ritual?

Why didn't her boyfriend, Micah Stewart, returning to the apartment after the forty-five minute window of time, report her missing to the police?  Did he think it normal that she left their two-week old baby alone in the apartment?  He didn't report her missing after the first day.  He didn't report her missing after the second day.  Only when her father stopped by and found her missing did her father call the police.

What did the police do?  A member of Lancaster Online Talkback posted this on October 10, 2004, under the thread, Why are Lancaster murders not publicized?  "In relation to other cases, such as the Cortney Fry case, it is a horror that this case is not getting more local attention.  There has been little to no attention to her plight.  I have seen one or two photographs of her and that was back in the summer.  There has been no further release of information.  No data concerning potential last known whereabouts.

No request to the public for, 'Have you seen her?  If so, who was she with, what was happening, what was

she wearing, when was it, where was it?' etc.  I have seen more information on Cold Case Files from cases that are 20 years old than what there is with this case. ... If the Columbia cops are not competent to handle this investigation, they need to had it over to an authority that is equipped to handle it, and do it before it gets colder than it already is."

Lancaster detectives apparently are not competent to handle the investigation either.  After six months and the discovery of the body, no one has been charged.  In an article entitled, "Missing person case ends; homicide probe begins," in the Intelligencer Journal on January 25, 2005,  it says, "Lancaster County District Attorney Donald Totaro said Monday the investigation is still in the preliminary stages, and detectives are not ready to charge anyone with the slaying."  In an article in the New Era on the same day

titled, "Fry family plans funeral," and regarding what the autopsy found, the author states, "Totaro declined  to comment on that information or other developments, saying he did not want to compromise the investigation."  The article also states that investigators of the crime scene, "...already found 'significant other forensic evidence in their initial probe of the scene.'"

Not one bit of official information has been released.  If she was shot, what kind of gun was used? Did they recover a bullet/bullets?  Did her boyfriend own a gun?  Did he purchase one recently?   Wouldn't it help if the public knew this information and could provide tips?

The public has a right to know what is being done to protect them.  A woman has been brutally murdered and no one has been arrested or charged in the crime.  Almost no information has been released to the public.  There is a murderer on the loose and there has been for six months.  If the Lancaster detectives can not solve this case then outside authorities need to be brought in immediately.

There is a killer on the loose and no one can feel safe until the police make an arrest in this case.

"I BELIEVE MY SON IS INNOCENT"

(Intelligencer Journal, January 26, 2005, by Brett Lovelace)

David Stewart, the father of Micah Stewart, the boyfriend of Cortney Fry and quoted in the above story certainly is familiar with legal proceedings.  You can pull up his record yourself.  Go here:  http://www.co.lancaster.pa.us/scripts/bannerweb.dll

Then click on “Party Search” in the upper left-hand corner, put in Stewart and then David and click on “Query.”  He is David A. Stewart and I believe all of the David Stewarts are the same person as well.  Again, these are all Civil Court records and do not include criminal records.

IT'S A CRIME

The promised story regarding the Intell's Wednesday article, "I believe my son is innocent" will be part of this weekend's in-depth look at the Cortney Fry case.  Let it just be said for now that the article was an indication that Stewart would not be charged with the crime and  officials hope the case will disappear from the headlines and go down as yet another unsolved Lancaster County crime.

Columbia Police Chief Joseph Greenya was quoted in the Columbia Ledger on August 12, 2004 saying the following regarding national media attention to the case, "Because there is such a high ratio of missing people that they tend to pick up other cases rather than the one here in little old Columbia."

The "little old Columbia" line, Mr. Greenya?  I think you have some work to do in your little town.  In an Intelius report on the city of Columbia, this is what is listed:

Crime

Murder:

Below Average

Rape:

Above Average

Robbery:

Above Average

Assault:

Above Average

Burglary:

Above Average

Larceny:

Above Average

Vehicle Theft:

Above Average

Arson:

Above Average

These  statistics are gathered from police records and the average is based on a nationwide scale.  One out of eight is not good for "little old Columbia," Mr. Greenya.  It's really not good at all.  I think you have some work to do.  Your salary is paid by taxpayers as are all police officers.  You're paid to protect us and catch the "bad guy" when a crime occurs.  I think it's time for some performance reviews.
