APPLICATION REQUESTING AN ORDER DIRECTING
THAT A COUNTY INVESTIGATING GRAND JURY BE SUMMONED
TO THE HONORABLE LOUIS J. FARINA, PRESIDENT JUDGE OF THE COURT OF COMMON PLEAS OF LANCASTER COUNTY:
Donald R. Totaro, District Attorney of Lancaster County, Pennsylvania, hereby makes application for the summoning of an Investigating Grand Jury and respectfully represents as follows:
1. Applicant is the duly elected District Attorney of Lancaster County.
2. The convening of an Investigative Grand Jury is necessary because of the
existence of criminal activity within Lancaster County which can best be fully investigated using the investigative resources of the Grand Jury. This conclusion has been reached after appropriate investigation and consideration by the District Attorney and law enforcement personnel.
3. The applicant has identified particular investigations which are now in
progress, or which are contemplated in the near future, which can best be fully investigated using the resources of the Grand Jury.
4. Examples of the criminal activity which can best be fully investigated
using the resources of the Grand Jury include, but are not limited to, the following: illicit drug enterprises and related activities; racketeering as defined under the Pennsylvania Corrupt Organizations Statute, and unsolved homicides.
5. Should the Court grant this application, matters which require the
resources of the Investigating Grand Jury for adequate and proper investigation will also be submitted as authorized by 42 Pa.C.S.A. & 4541 et. seq.
WHEREFORE, pursuant to 42 Pa.C.S.A. & 4543(b), the District Attorney of
Lancaster County respectfully requests that the President Judge of the Court of Common Pleas of Lancaster County issue an order directing that an Investigating Grand Jury be summoned and convened, and that a supervising judge thereof be appointed.

AND NOW, this 14 day of February, 2005, pursuant to and based upon the application of the District Attorney, it is hereby ORDERED that an Investigating Grand Jury be summoned to be designated Grand Jury II. The Court finds that the facts set forth in the District Attorneys Petition requesting an Investigating Grand Jury adequately demonstrate the need for the summoning of a County Investigating Grand Jury.
The Honorable Louis J. Farina, President Judge of the Court of Common Pleas of Lancaster County, is designated as the Supervising Judge of this Grand Jury.
